Terms and Conditions
Important Notice
Dashify Express Inc. (hereinafter referred to as "Dashify Express"), its management, employees, and agents shall not be held liable for losses and damages under the circumstances stated in Condition No. 9.
Even in cases where Dashify Express is held liable, the maximum liability is strictly limited as outlined in Condition No. 6. Customers are strongly advised to read and understand these terms and conditions before proceeding with any transactions.
1. Consignment Note (Air Waybill)
The Air Waybill (AWB) is a non-negotiable document, and it is confirmed that it was prepared either by the Shipper or Dashify Express on behalf of the Shipper. The Shipper guarantees that they are the lawful owner of the cargo or an authorized agent acting on behalf of the cargo owner and agrees to be bound by these terms and conditions.
2. Shipper's Obligations and Responsibilities
- Each item is accurately described on the Air Waybill and is not listed as a prohibited item.
- Items are properly packaged as per the packaging guidelines in Appendix I.
- If the cargo remains unclaimed for 30 days, Dashify Express may transfer it to another storage facility.
- If the cargo is unclaimed for 60 days, Dashify Express has the right to auction or dispose of the cargo.
- Dashify Express will not release cargo until all outstanding fees are paid.
3. Prohibited and Fragile Items
- Prohibited Items: Illegal drugs, narcotics, flammable substances, corrosive chemicals, toxic liquids, hazardous materials, and items prohibited under Philippine law.
- Fragile Items: Fragile items are shipped at the Shipper’s own risk. Dashify Express is not liable for damage to fragile items during transit.
4. Inspection of Cargo
Dashify Express reserves the right to allow the Bureau of Customs (BOC) and General Administration of Customs (GACC) to inspect cargo if necessary. Dashify Express is not liable for delays or damages caused by these inspections.
5. Lien on Goods
Dashify Express retains a lien on all cargo to secure payment of fees, and Dashify Express may withhold delivery until all fees are paid in full.
6. Limitation of Liability
The maximum liability for loss or damage is PHP 25,000. The liability is determined by the lowest of the following:
- Actual loss or damage to the cargo.
- Declared value by the Shipper.
- 5 times the shipping cost from China to the Philippines.
7. Exclusion of Consequential Damages
Dashify Express is not liable for consequential or indirect damages, such as loss of profits or market value.
8. Liabilities Not Assumed
- Delays due to natural disasters, war, or other events beyond Dashify Express's control.
- Losses caused by acts or omissions of the Shipper or third parties.
9. Claims Procedure
- Claims must be reported within 24 hours of receipt of the cargo.
- Claims must be submitted within 7 days to the Customer Care Team.
- Dashify Express will not honor claims unless all fees are paid in full.
10. No Consolidation Policy
Dashify Express does not allow consolidation of cargo at its warehouses in China. All shipments must follow the FIFO (First In, First Out) policy.
11. Pick-up Policy
- No partial pick-ups are allowed.
- All items listed on the Air Waybill must be collected at once.
12. Pricing and Fees
Pricing is based on rates listed on the Dashify Express website. Fees are final and may be subject to change without prior notice.
13. No Pull-out Policy
Once cargo has arrived at the Dashify Express China warehouse, it cannot be pulled out.
14. Applicability
These terms apply to Dashify Express Inc., its affiliates, agents, officers, and employees.
15. Governing Law and Jurisdiction
These terms are governed by Philippine law. Any disputes will be subject to the jurisdiction of Philippine courts.
Appendix I - Packaging Guidelines
- Each package must be fully enclosed in protective material.
- Items must be tightly packed, with gaps filled by bubble wrap or other materials.
- Fragile items must be wrapped in bubble wrap and placed inside a secure container.
- Crates are required for large, bulky, or delicate items that need extra protection.
